SECTION 0 - Preamble
ARTICLE 1 - Purpose and Definitions
The website https://pommia.shop/ is published by Julia OLIVIER, manager of the eponymous individual business (micro-enterprise) whose registered office is located at Building A, 10 Rue de la Gendarmerie, 57330 Hettange-Grande, identified at the Commercial and Companies Registry of Thionville under number 853 629 905.
The words “Seller” or “we”, “us” and “our” means Pommia Shop.
All the terms defined below will be used throughout these General Terms and Conditions. These terms will be written with a capital letter.

ARTICLE 2 - Scope of application of the GTCSU
The following General Terms and Conditions of Sale and Use (GTCSU) include on the one hand the General Terms and Conditions of Sale (GTCS) and on the other hand, the General Terms and Conditions of Use (GTCU).
These Terms and Conditions describes the Customer’s rights and responsibility when they use the Website or place an Order.
The Customer is requested to review carefully the following Terms and Conditions, as they contain important information about their legal rights.
The Customer must review the GTCU before browsing the Website.
By visiting or using the Website, the Customer automatically consent to these GTCU and our Privacy Policy. If the Customer does not agree with these Terms and Conditions or the Privacy Policy, they must immediately stop using the Website.
The GTCS, on the other hand, apply, without restriction nor reservation, to all Orders concluded.
An Order can only be validated by the Client after acceptance of the GTCS by a checkbox, with a time-stamping system. Bypassing this checkbox will render the Order null and void.
Pommia Shop reserves the right to modify the GTCSU at any time and without prior notice.
The changes will be applicable as soon as they are posted online.
An up-to-date version of the GTCSU is always made available to Customers under a direct link in the footer of the Website.
For each Order, the GTCSU in force and applicable at the time of the Order will be sent as an attachment on a durable medium (PDF format) in the Order confirmation e-mail.

SECTION 1 – General Terms and Conditions of Sale
ARTICLE 1 - Products
The Products offered for sale are those mentioned on the Website on the date the Customer consults the Website.
The main characteristics of the Products are listed in their Product Description.
The Customer is asked to review it carefully before placing any Order.
All Product Descriptions are subject to be edited at any time, without notice.
All the visual elements of the Products are not contractual. The colours or appearance of the Product may differ from how they appear on the Customer’s screen, due to the device model and its settings.
The Products are offered while stocks last and may be withdrawn from sale without notice.
In case of the information regarding Product availability is incorrect, the Seller commits to inform the Customer by email, providing all necessary details to ensure the good processing of their Order.
For logistical reasons, each Product is subject to a quantity limitation of five (5) copies per Order.
ARTICLE 2 – Order process and validation
2.1 Order process
The Customer selects the desired Products by browsing the Website and adding the Products to his cart by clicking on the Add to cart button displayed in the Product page. The cart is accessible at any time by a button (shopping bag icon) on the top right of the Website.
Once their cart is complete, the Customer can proceed to the payment by the Check out button. Beforehand, they must need to check a box to confirm their full acceptance of the GTCSU and the Privacy Policy.
By clicking on the Check out button, the Customer will be redirected to the secure service Shopify Payments to complete the payment and provide the shipping information. The Customer is aware that, during this redirection, their browsing is governed by the General Terms and Conditions of Shopify Payments (cf. Section 1, Article 4 – Payment)
The Customer will be required to provide some mandatory information:
- a valid email address,
- a first and last name for delivery,
- a postal address for delivery,
- a phone number (used only for delivery, no marketing operations will be conducted using this number),
- a payment method based on the selected payment method.
Optionally, the Customer can use a different first name, last name, and postal address as billing information.
Once this information has been provided, the Customer is invited to review their Order and details by clicking on the Review order button.
The Customer is required to check carefully the details provided; if anything is missing or incorrect, the Order will not be valid.
In that case, the Customer must contact us by email at pommia.shop@gmail.com to modify the Order. Otherwise, Pommia Shop reserves the right to contact the Customer or cancel the Order.
Once the information has been verified, the Customer is invited to validate the Order by clicking on the Pay now button.
2.2 Order validation and preparation
Once the Customer has completed the payment, a confirmation email is sent to the Customer.
This email includes the Order number and the details of the Products ordered.
Attached to this confirmation email, the Customer will be able to find the GTCSU in force when the Order was placed.
These terms will be the only ones applicable to the concluded sales contract.
Pommia Shop is committed to process any Order placed on the Website as soon as the payment is completed.
Once the Order is under preparation, the Customer will be notified by email including the invoice on a durable medium (PDF format).
The shipping time of an Order is two (2) working days, except in exceptional circumstances of which the Customer will be informed.
Please note that Orders placed on Friday afternoon, Saturday, or Sunday will only be processed the following Monday. Additionally, Orders placed on the Website on a French public holiday will only be processed on the next working day.
As soon as the Order is shipped, the Customer receives by email the tracking number of the parcel and all the information needed to follow the delivery process.
In accordance with Articles L.111-1 et seq. and L.121-17 of the French Consumer Code, the Customer acknowledges having been able to review the characteristics (listed in the Product Description) and prices of the Products, the payment methods accepted on the Website, the delivery terms and time, and the conditions for exercising the right of withdrawal and its cases of exclusion (cf. Section 1, Article 6 - Right of withdrawal), all before entering into a contract with Pommia Shop.
2.3 Order Cancellation and Modification
A modification of the Order can only be requested if this modification concerns the Customer's contact details necessary for the delivery of the Order.
Addition, deletion or modification of Product(s), or modification of the delivery method of an Order will not be possible.
To comply with these special requests, the Client must first cancel his Order and then renew it.
Any request to cancel an Order can be done, as soon as possible, by sending an email at pommia.shop@gmail.com.
For logistical reasons, Pommia Shop may not be able to honour a cancellation request when the Order is being processed.
When the Order is in the process of being delivered, it will be impossible for the Customer to cancel their Order, except in case of a delay in delivery (cf. Section 1, Article 5 - 5.4 Delivery times).
The Customer must wait for the receipt of the Order before exercising their right of withdrawal (cf. Section 1, Article 6 - Right of withdrawal).
Pommia Shop reserves the right to suspend any Order or delivery in case of payment failure or payment incident (false bank details, lack of funds in the Customer’s bank account, refusal of payment authorisation by accredited organisations, etc.).
The Customer needs to contact Pommia Shop at pommia.shop@gmail.com if they want to clarify their situation. The Order will be definitively cancelled if the Customer has not contacted Pommia Shop after five (5) working days. If the Customer is unable to regularise their situation after fifteen (15) working days, Pommia Shop reserves the right to definitively cancel the Order.
In any case, the Customer will be kept informed at the email address provided when they placed the Order.
2.4 Limitations
The Products presented on the Website are intended exclusively for individuals. Pommia Shop reserves the right to cancel any Order placed by a business or a professional. The Customer represents and warrants that their purchases are for personal or household use and not for commercial resale or export.
Pommia Shop reserves the right to cancel any Order non-compliant, suspicious, or placed in bad faith. Thus, Pommia Shop reserves the right to refuse any Order from a Customer with whom there is any previous or ongoing dispute or with whom there is a doubt of his loyalty or good faith.
If Pommia Shop cancels any Order, we will notify the Customer by contacting the email address provided at the time of Order.
Orders can be returned or exchanged in accordance with the following articles: Section 1, Article 6 - Right of withdrawal and Section 1, Article 7 - Conformity - Guarantee against hidden defects.
If a Product is out of stock, Pommia Shop commits to informing the Customer as soon as possible by contacting the email address provided at the time of Order. The Customer will be informed of the restocking time for the affected Product.
If restocking is not planned or if the delay is more than thirty (30) days, Pommia Shop will offer the Customer the opportunity to choose a Product of equivalent value.
If the Customer is not interested, the Product will be fully refunded via the payment method used during the Order.
ARTICLE 3 – Price
The price of each Product is indicated in the Product Description, in euro (€) and all taxes included.
These prices are net and include the cost of the Products as well as packaging and handling costs.
They are valid only on the date the Order is confirmed and may be changed later without notice.
Delivery costs are not included in the price of the Products. Delivery costs vary depending on weight of the Order and the destination country.
They will be calculated at the time of payment of the Order, when the Client will be required to provide his contact details.
Pommia Shop will never be required to cover any additional costs related to the delivery of the Order (local taxes, customs duties, etc.).
ARTICLE 4 – Payments
4.1 Payment terms and case of non-payment and delay
The Customer represents and warrants that they are of legal age, that the purchase is made for strictly personal use, that they are the holder of the payment method used and that the name on it is indeed their own. The Customer must ensure that they have sufficient funds to cover the payment.
Pommia Shop reserves the right to suspend any Order or delivery in case of payment failure or payment incident (false bank details, lack of funds in the Customer’s bank account, refusal of payment authorisation by accredited organisations, etc.).
The Customer needs to contact Pommia Shop at pommia.shop@gmail.com if they want to clarify their situation. The Order will be definitively cancelled if the Customer has not contacted Pommia Shop after five (5) working days. If the Customer is unable to regularise their situation after fifteen (15) working days, Pommia Shop reserves the right to definitively cancel the Order.
4.2 Payment methods
During the Order process, the Customer is redirected to the Shopify Payments service, the payment service chosen by Pommia Shop, to proceed to the payment.
The Customer is informed that from the moment they are redirected to the Shopify Payments service, their browsing is governed by the General Terms and Conditions of Shopify Payments.
The Customer is informed that no bank or payment data is collected by Pommia Shop. The Shopify Payments service is solely responsible for the collection and processing of this data.
To learn more about it, the Customer can refer to the General Terms and Conditions of Shopify Payments and our Privacy Policy.
In accordance with the Data Protection Act of 6 January 1978 amended in 2004, the Client has, at any time, the right to access, rectify, modify and delete data concerning them. The exclusive contact for the Customer to exercise this right is Pommia Shop at the address pommia.shop@gmail.com. The Customer is requested to write to this address and to prove his identity for each request.
Pommia Shop accepts the following payment methods:

ARTICLE 5 – Delivery
5.1 Delivery methods
Pommia Shop uses the services of Colissimo for the delivery of its parcels.
The Order will be delivered to the address provided by the Customer at the time of the Order, respecting the list of countries in our delivery zones.
The only delivery method offered is home delivery with signature, whether the Customer is in France or located internationally.
The Client will have at his disposal a tracking number to follow each step of the delivery.
For the following countries, the tracking is only guaranteed up to the border of the destination country: Norway, Philippines, Taiwan, Vietnam.
The Customer is informed that this list may change at any time, and that Pommia Shop cannot be held responsible for the momentary and unpredictable absence of tracking in any other country.

The list of our delivery zones is subject to change depending on demand or the geopolitical situation.
*Due to the current geopolitical situation in the United States and the new customs duties imposed, shipping to this country is temporarily suspended.
5.3 Delivery costs
Delivery costs are those indicated at the time the Customer confirms the Order. They vary depending on the weight of the Order and the destination country. They will be determined during the payment process, when the Customer is required to provide their contact details.
The delivery costs are shown VAT included. Pommia Shop will never be responsible for covering additional costs related to the delivery of the Order (local taxes, customs duties, etc.).
5.4 Delivery times
Delivery times are specified during the Order process.
Pommia Shop commits to make every effort to deliver Orders within the time indicated.
If the delivery time is exceeded by more than forty-eight (48) hours, the Customer must notify Pommia Shop by email at pommia.shop@gmail.com of their decision regarding the next steps:

Request that Pommia Shop investigates with the carrier (the investigation will not exceed thirty (30) days). If the parcel cannot be located, the Customer may choose between reshipping the Order or receiving a full refund.
or
- Cancel their Order and request a full refund.
5.5 Delivery Conditions
The Customer commits to do everything possible to receive the parcel:
- provide an accurate delivery address;
- in case of absence, contact the delivery service to reschedule delivery, or enquire with the delivery service about where the parcel can be collected.
Pommia Shop is not responsible for any delivery delays if the above requirements are not met by the Customer.
In such cases, no new shipment or refund of the Order can be processed without the good receipt of the returned parcel by Pommia Shop.
The responsibility for risks related to the transport of Products lies with Pommia Shop until the parcel is handed over to the Customer. The transfer of risks to the Customer only occurs when the parcel is handed over to the Customer.
Pommia Shop guarantees that the Products are in perfect condition, or at least in the condition defined by the grade (A, B, C) selected by the Customer, at the moment they are handed over to the carrier.
It is recommended that the Customer refuse any parcel with an external condition appearing excessively damaged at the time of delivery.
According to postal regulations, a delivery person is not authorised to witness the opening of the parcel. Therefore, the refusal must only be based on the external condition of the shipping box, as the delivery person cannot accept a return of a parcel opened.
If the Customer accepts the parcel despite external damage, it is recommended to report the deterioration to the delivery person.
The Customer must also send a copy of their reservations to Pommia Shop by email at pommia.shop@gmail.com.
If the unopened parcel is given to a neighbour, a caretaker, or placed in the Customer’s mailbox, and they notice damage to the shipping box, the Customer is requested to return it, still unopened, no later than the next business day, to a post office. The parcel will then be sent back to Pommia Shop.
As long as this procedure is followed and the damage to the parcel and Products is confirmed, Pommia Shop may, at the Customer's choice, issue a credit note, proceed with a full refund of the Order (including delivery costs), or arrange a new shipment of identical Products.
If the Customer experiences any problems during delivery, they are invited to contact Pommia Shop by email at pommia.shop@gmail.com.
ARTICLE 6 - Right of withdrawal
In accordance with the provisions of Articles L. 221-18 et seq. of the French Consumer Code, the Customer has a maximum period of fourteen (14) calendar days to exercise their right of withdrawal, without having to justify the reason.
This period begins on the day the relevant Product(s) are received, or the day the last Product of the Order is received if it has been split and delivered in several shipments.
If the fourteen (14) days period expires on a non-working day (Saturday, Sunday, french public holiday, or non-business day), it is extended until the next working day.
Returns of Products can never be made at the sole initiative of the Customer.
To exercise their right of withdrawal, the Client must:
- fill in the withdrawal form available at the following link (recommended): Download form (PDF)
or
- write a statement expressing their willingness to withdraw.
This form/declaration must be sent by email at pommia.shop@gmail.com.
Pommia Shop will then contact the Customer using the information provided to arrange the return of the Products.
The Customer has a maximum of fourteen (14) calendar days, after validation and reception of the return label by email, to return the parcel.
If the Customer exercises their right of withdrawal for the entire Order, the refund will include the total amount of the Order as well as the delivery fees paid for that Order.
If the Customer exercises their right of withdrawal for only a part of an Order, the refund will include only the value of the relevant Product(s).
The price of this return label is due to the Customer and will be deducted from the refund of the Order.
The refund will be processed as soon as possible, starting from the receipt of the returned Product(s), and no later than fourteen (14) days following their receipt.
The refund will be made via the payment method used for the purchase.
However, the refund can only be issued if the Product is returned in perfect resalable condition, including all potential accessories and if possible, in its original packaging or in packaging offering a level of protection equivalent of the original packaging. Additionally, Products that have been unsealed and/or mixed inseparably with other Products will not be refunded.
The Customer only can exercise this right of withdrawal. If the Order is delivered to a person other than the Customer, this right cannot be exercised by the recipient of the Order.
ARTICLE 7 - Conformity - Guarantee against hidden defects
In accordance with Article L. 111-1 of the French Consumer Code, the Products offered on the Website are subject to the conditions of legal guarantee of conformity and the guarantee of hidden defects.
7.1 Legal guarantee of conformity
Pommia Shop is required to deliver goods that conform to the contract and is responsible for any non-conformities existing at the time of delivery.
Pommia Shop is also liable for defects resulting from the packaging and assembly instructions (Article L. 217-3 of the French Consumer Code).
A product is compliant, according to Article L. 217-5 of the French Consumer Code, when it matches the description, type, quality, and quantity specified in the contract and is delivered with instructions and accessories.
It must also be suitable for the usual use of similar goods or, if applicable, matches the description provided by the Website and possess the qualities that a buyer can reasonably expect based on public statements made by Pommia Shop.
However, the Customer is solely responsible for choosing the Products, as well as for their storage from the time of delivery and their use. Under no circumstances Pommia Shop can guarantee that the Order will meet the specific expectations of the Customer.
Furthermore, the Customer cannot dispute the conformity of a Product if they were aware of the defect making the good non-conforming before the contract was concluded, or if the defect observed does not come from the Product but from misuse of it.
Because Pommia Shop sells only new Products, the Customer benefits from the legal guarantee of conformity for two (2) years, without having to prove that the defect existed at the time of sale.
In the event of a lack of conformity, Pommia Shop will offer the Customer either replacement or repair of the good. The choice is up to the Customer, unless this results in a manifestly disproportionate cost, regarding the value of the Product or the significance of the defect. The Product must be brought back into compliance within a maximum period of thirty (30) days following the Customer's request.
No fees will be charged to the Customer for replacement or repair, except for delivery costs, which will be refunded to the Customer within fourteen (14) days.
The Customer must provide proof of payment indicating the amount of delivery costs to obtain the refund.
7.2 Legal guarantee of hidden defects
Pommia Shop is liable for the guarantee of hidden defects, meaning: “hidden defects in the item sold which render it unfit for its intended use, or which impair that use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, had he been aware of them” (Article 1641 of the French Civil Code).
Pommia Shop is not responsible for any apparent defects explicitly announced in the Product Description, which the Customer has known before concluding the contract.
The defect must predate the sale and render the goods unfit for their intended use. It is up to the courts to determine whether the item sold is unfit for its purpose.
The time limit for taking action is two (2) years from the discovery of the defect.
The Customer may choose between returning the Product and receiving a full refund, or keeping the Product and receiving a partial refund, as arbitrated by experts.
ARTICLE 8 - Retention of Title
In accordance with the Dubanchet law of May 12, 1980, Products delivered to the Customer are sold with retention of title.
Under normal circumstances, property of the Product is transferred on the delivery of the Product to the Customer.
The retention of title clause allows the transfer of ownership of the Product to be delayed until the full payment of the Product price by the Customer, even if it has already been delivered to them.
The Products therefore remain the property of Pommia Shop, until full payment of the Orders.
ARTICLE 9 – Limitation of liability
Pommia Shop declines all responsibility:
- in case of out-of-stock or unavailability of the Product;
- in case of disruption, total or partial strikes, especially postal services or means of transport and/or communications;
- for any interruption, malfunction, or inaccessibility to the Website;
- for any misuse or misconfiguration of the Customer’s computer;
- for any damage of any kind resulting from fraudulent intrusion by a third party, leading to a modification of the information provided on the Website;
- for any failure due to an event of force majeure as defined by Article 1218 of the French Civil Code and without limitation: disasters, strikes, fires, floods, breakdowns or failures of transport or communication equipment, or because of the actions of the Client;
- for any indirect damage such as, notably, loss of profits, missed opportunities, loss of data, or loss of clientele that may result, among other things, from the use of the Website, or on the contrary from the inability to use it.
In any case, regardless of the reason for Pommia Shop being accused, its responsibility is limited to the lesser of the following two amounts: (1) the amount of direct damage suffered by the Customer or (2) the price of the Order.
ARTICLE 10 – Proof
The computerised records stored in the information systems of Pommia Shop and its partners, under reasonable security conditions, will be proof of exchanges, orders, and payments made between Pommia Shop and the Customer.
ARTICLE 11 – Governing Law and Disputes
Pommia Shop has translated these GTCSU into both French and English.
Only the original translations made by Pommia Shop of these GTCSU are considered authoritative in case of a dispute.
The rights and obligations of the parties are governed by French law, specifically including:
- the articles L.111-1 et seq. and L.217-1 et seq. of the French Consumer Code;
- the rules for distance selling (Articles L. 121-16 to L. 121-20 of the French Consumer Code);
- the law for Confidence in the Digital Economy of June 21, 2004;
- the law on Data Processing, Files, and Freedoms of January 6, 1978;
- the rules relating to the mediation of consumer disputes (Articles L. 151-1 et seq. of the French Consumer Code);
- the article 1641 of the Civil Code relating to the legal guarantee against hidden defects;
- the Dubanchet law of May 12, 1980 concerning retention of title.
For any national or cross-border disputes that may arise concerning the validity, interpretation, performance or non-performance, interruption or termination of any contract concluded under the conditions set out in these GTCSU, the French courts will have exclusive jurisdiction.
SECTION 2 – General Terms and Conditions of Use
ARTICLE 1 - Access to the Website
The Website is open to all and accessible free of charge, wherever the User has an Internet connection.
All costs related to accessing the Website, such as computer equipment, software, or Internet subscription, remain the sole responsibility of the User.
Once the User places an Order, they become a Customer.
From that moment, a personal space on the Website will automatically be assigned to them where they can find all information related to their past Orders.
To log in to this space, the User must click on the account icon, accessible at any time in the Website header, and enter the email address used when placing their Order.
No password is required: a code will be sent to that same email address.
No passwords are stored on the Website.
The User may request to unsubscribe from the Website by contacting Pommia Shop at the email address pommia.shop@gmail.com. This will take effect within a reasonable period.
In the event of force majeure or in the case of an interruption or modification due to maintenance causing a malfunction of the Website or server, Pommia Shop cannot be held responsible. The User therefore acknowledges that any suspension or discontinuation of the service, including without prior notice, cannot be attributed to the publisher.
ARTICLE 2 - Data Collection
The Website guarantees that it collects and processes the User’s personal information with respect for their privacy and in accordance with the Data Processing, Data Files and Individual Liberties law of January 6, 1978.
In line with these regulations, the User has the right to access, correct, and delete their personal data.
The User can exercise this right by submitting their request to the following email address: pommia.shop@gmail.com.
ARTICLE 3 – Cookies
A cookie is a small file stored by a server on the terminal (computer, phone, etc.) of a user and associated with a web domain. This file is automatically sent back during next contacts with the same domain.
The use of certain features of the Website requires the User’s prior acceptance of cookies. If cookies are not accepted, access to certain pages or features of the Website may be restricted.
ARTICLE 4 - Hypertext Links
A hypertext link is an element of a website that enables a user to move from one web page to another via a system of redirects known as hyperlinks or hypertext links. These can take various forms, such as bold underlined text, but also an image, a button, etc.
On the Website, a hypertext link may redirect either to another page of the Website, or to an external website.
When the link leads to an external website, the User is informed that by clicking on this link, they will leave the Website.
The User is required to familiarise themselves with the policies of the third-party website before continuing their browsing.
Pommia Shop has no control over the web pages to which these links redirect and cannot be held responsible for their content.
ARTICLE 5 - Intellectual Property
Use of this Website is strictly limited to personal purposes.
The French laws governing literary and artistic property rights, or other similar rights, protect the Website.
All elements of the Website, including texts, trademarks, designs, models, logos, graphics, etc., are the exclusive property of Pommia Shop and do not grant any licence or any other right except for reading/viewing them on the Website.
